La Declaración fue presentada al público en el VI Foro Cultural Internacional en San Petersburgo, Rusia.

DECLARACIÓN DE LOS DERECHOS Y DE LA LIBERTAD 

DE LOS DELFINES Y LAS BALLENAS

Basándonos en un complejo de unas investigaciones científicas y unas observaciones que manifiestan que los cetáceos poseen de un intelecto desarrollado, de los sentimientos, de un complejo sistema social;

tomando en consideración un amplio movimiento en la defensa de los cetáceos;

teniendo en cuenta una serie de precedentes en esta área (leyes nacionales sobre la prohibición o no reposición de los delfinarios, las declaraciones tomadas sobre el reconocimiento de los delfines y de las ballenas las personalidades no-humanas, la creación de las zonas protegidas marítimas internacionales  para las ballenas y los delfines);

reconociendo el peligro, que presenta para los delfines y para las ballenas la actividad humana, asimismo su imprtancia para la biosfera del planeta; 

partiendo de la etapa actual del desarrollo de la civilización humana, que exige cada vez más responsabilidad del ser humano ante el Planeta y la vida en general;

declaramos:  

1. Todos los delfines y las ballenas se reconocen como unos seres, que poseen de autoconciencia, intelecto y sentimientos.

 

2. Los delfines y las ballenas nacen y se quedan libres y tienen derecho a vivir libremente y desplazarse en su medio natural y no pueden ser retirados de su medio o separados de sus grupos familiares forzosamente.

 

3. La matanza de los delfines y de las ballenas está prohibida, su vida no puede correr peligro, no pueden ser sometidos al maltrato.

 

4. Los delfines y las ballenas no pueden ser atrapados, hacerse presos, ser objeto de compra – venta o de alquiler; no pueden ser propiedad de ningún estado, empresa o particular.

 

5. Los delfines y las ballenas no pueden ser utilizados como medio de diversión o de actos bélicos, ni someterse a fuerza a los experimentos invasivos. Cualquier amaestramiento de los delfines y de las ballenas se reconoce como una forma de esclavitud.

 

6. Los delfines y las ballenas tienen derecho a la no-intervención en su cultura. La observación de los delfines y las ballenas puede realizarse únicamente en el medio natural y debe ser regulada por las normas internacionales que garanticen su tranquilidad y seguridad.

 

7. La pesca debe prever las medidas legislativas  que protejan a los delfines y a las ballenas de una caída imprevisible en las redes, asimismo la responsabilidad por la contaminación del espacio acuático (incluido la contaminación acústica), que pueda provocar peligro para la vida y para la salud de los delfines y de las ballenas. 

 

8. Las rutas regulares de los barcos comerciales y de pasajeros no pueden pasar por los lugares que se eligen durante un período por grupos de delfines y ballenas como el lugar principal de su habitat.

 

9. Ningún tipo de actividad científica o de ilustración puede ser causa para cualquier obligacion para los delfines y las ballenas para su permanencia en cautiverio. La única excepcion de esta prescripción debe ser la necesidad de la prestación de la asistencia médica o la salvación de un peligro inminente y solo para el período en que necesiten ayuda.

 

10. Los derechos y las libertades establecidad por dicha Declaración deben ser protegidos por la legislación internacional y nacional. La violación de cualesquiera de estos principios será considerada como un delito penal contra la personalidad y contra la humanidad entiende la responsabilidad jurídica.
